How Does a Company Dispute Information on a Roadside Inspection?

If you believe a roadside inspection report contains incorrect defects or information you can dispute the information by filing a DataQ through the FMCSA portal. The Request for Data Review (RDR) should contain any supporting documentation such as photos, repair records, log pages maintenance records, and appropriate sections of the rules and regulations. The most common reason for a challenge not being successful is a lack of documentation. The burden of proof is on the requestor.

After logging into the portal and completing RDR, it is automatically forwarded to the appropriate office for resolution. If you currently do not have a login, you will need to create one before filing the RDR. If you are a motor carrier with an existing FMCSA Portal account and you already requested DataQs as an available system, visit the FMCSA Portal to log in. Then, you can access DataQs for the corresponding U.S. DOT Number.

The DataQ process can also be used by drivers to file concerns about the Pre-Employment Screening Program (PSP) and to monitor the status of an RDR.
