ISRI Time Capsule: Going Against the Flow Control

Flow control-- attempts by government to control materials that were diverted or removed from the solid waste stream for the purpose of recycling—became a hot topic in the early 1990s.
March22LUTimeCapsuleFlowControlThe ISRI board passed a position at its July 1991 meeting in Minneapolis strongly opposing flow control. The battle raged on for the next few years, but then flow control proponents suffered a major defeat in May 1994 when the U.S. Supreme Court ruled in C&A Carbone Inc. vs. Town of Clarkstown, N.Y., that Clarkstown’s flow control law interfered with interstate commerce and, thus, violated the U.S. Constitution’s commerce clause.” Unfortunately, this wasn’t the last recyclers would hear from flow control supporters.
